التدخل الإنساني

نفتح النقاش حول ما اصطلح على تسميته بالتدخل الإنساني خلال التسعينات، وذلك مع تطور تكنولوجيات الإعلام والاتصال التي نقلت إلى العالم المعاناة الانسانية التي شهدها بالخصوص البلقان والبحيرات الكبرى. وتاريخيا، فإن هناك سوابق لتفعيل آليات التدخل الهادف إلى إنهاء التجاوزات التي تطال حقوق الإنسان وبالخصوص الحق في الحياة، حيث تدخلت القوات الفيتنامية عام 1978 في كمبوديا لوضع حد لجرائم الإبادة التي ارتكبها نظام بول بوت.

ومع أن القاعدة التي أرستها معاهدة واستفاليا هي تحريم التدخل في الشؤون الداخلية للدول، إلا أن الضمير الإنساني لم يتحمل أن ينأى بنفسه بعيدا عن صور المجازر والمذابح التي ترتكب ضمن إقليم دولة معينة، والوقوف موقفا سلبيا أمام تحجج الطرف المعتدي بالسيادة والمواثيق الدولية التي تحرم التدخل في الشؤون الداخلية للدول الأخرى. ذلك ما تم التعبير عنه في حالة كوسوفو، التي تمثل نموذجا للتدخل الإنساني الذي يتجاوز المرجعية الأممية، فقد لجأت دول الناتو إلى شن حملة قصف جوي لـ 78 يوما ضد بلغراد لإرغامها على وقف التجاوزات الصربية في حق ألبان كوسوفو.

ويجدر التمييز بين التدخل في الشؤون الداخلية لدولة أخرى interference من خلال التصريحات التي تدين خرق حقوق الإنسان مثلا، وبين الحضور المادي لدولة أو مجموعة من الدول -غالبا عبر استعمال وسائل القهر العسكري- بغية إيقاف تلك الخروقات، وهذا هو مضمون التدخل الإنساني الذي يمكن تعريفه على أنه استعمال القوة من طرف دولة واحدة أو أكثر، بوجود غطاء أممي أو دونه، بهدف وضع حد للمعاناة الإنسانية التي تتسبب بها عادة حكومة الدولة المستهدفة. ويثير ذلك مسألة الرضى consent، فالتدخل الإنساني لا يستوجب الحصول على رضى حكومة الدولة المستهدفة بخلاف المساعدات الإنسانية التي تستوجب ذلك.

ورغم أن التدخل لأغراض إنسانية أو لغيرها محرم بموجب المواثيق الدولية، وخاصة المادة 2 (4) من ميثاق الأمم المتحدة، إلا أن شرعية هذا التحريم لم تستطع الصمود أمام فظاعة الجرائم المرتكبة ضد الإنسانية والتناحر الإثني عقب نهاية الحرب الباردة، خاصة تلك التي راح ضحيتها ثمانمائة ألف شخص من التوتسي والهوتو منتصف التسعينيات. ومن ذلك الحين فقد أخذ النقاش حول الموضوع منحيين.

المنحى الأول تمحور حول المخاوف من استغلال المعاناة الانسانية كذريعة لتنفيذ أهداف سياسية أو استراتيجية، ويتضح ذلك من خلال إحجام الولايات المتحدة ودول الناتو الأخرى عن التدخل في مناطق ليس لها فيها مصالح على المحك، بينما تم تحدي الشرعية الدولية عندما تعلق الأمر بكوسوفو. أما المنحى الثاني فقد تمحور حول المقاربة للتدخل الإنساني كمسؤولية تستوجب تحرك المجتمع الدولي لاتخاذ ما يراه مناسبا من إجراءات، وهنا لم يعد الموضوع منصبا حول شرعية التدخل، بل حول طبيعة الخروقات التي تستوجب التدخل. لقد أدى ذلك إلى إثارة إشكالية عدم الحصول على تعريف موحد لحقوق الإنسان والتي يخضع تعريفها لاعتبارات ثقافية، ما يعني أن مفهوم التدخل في حد ذاته سيبقى رهينا للسياق الثقافي الذي يتم تفعيله في إطاره.
