إجراءات طلب الجنسية الجزائرية


كيفية استخراج شهادة الجنسية الجزائرية الأصلية و إجراءات اكتسابها بالنسبة للأجانب
شهادة الجنسية الجزائرية هي الوثيقة الوحيدة التي بموجبها يثبت الشخص تمتعه بالجنسية الجزائرية.

يمكن استخراج شهادة الجنسية الجزائرية من أي محكمة من محاكم القطر الوطني باعتبار هذه الأخيرة هي السلطة المؤهلة قانونا لإصدار شهادة الجنسية الجزائرية.

الوثائق اللازمة لاستخراج شهادة الجنسية الجزائرية:
أولا: الجنسية الجزائرية الأصلية، و تتضمن ثلاث حالات:

أ- الجنسية الأصلية: بالنسب، المادة 6 من قانون الجنسية الجزائرية.

• الأب جزائري، و تتضمن ثلاث حالات:

» الحالة الأولى: بالنسبة للولد المولود من أب يحمل جنسية جزائرية أصلية:

› شهادة ميلاد المعني أصلية صادرة عن بلدية مكان ميلاده.
› شهادة ميلاد الأب أصلية صادرة عن بلدية مكان ميلاده.
› شهادة ميلاد الجد أصلية صادرة عن بلدية مكان ميلاده.
› طابع جبائي بقيمة 20 دج.

» الحالة الثانية: بالنسبة للولد المولود بعد اكتساب الأب الجنسية الجزائرية:

› شهادة ميلاد المعني أصلية صادرة عن بلدية مكان ميلاده.
› نسخة من مرسوم اكتساب الأب الجنسية الجزائرية.
› طابع جبائي بقيمة 20 دج.

» الحالة الثالثة: من تحصل والده على الجنسية الجزائرية بموجب حكم قضائي:

› شهادة ميلاد المعني أصلية صادرة عن بلدية مكان ميلاده.
› شهادة ميلاد الأب أصلية صادرة عن بلدية مكان ميلاده.
› نسخة تنفيذية للحكم القضائي المثبت للأب جنسيته الجزائرية الأصلية.
› طابع جبائي بقيمة 20 دج.


• الأم جزائرية، تتضمن ثلاث (3) حالات:

» الحالة الأولى: الولد المولود من أم تحمل الجنسية الجزائرية الأصلية:

› شهادة ميلاد المعني أصلية صادرة عن بلدية مكان ميلاده.
› شهادة الجنسية الجزائرية للأم.
› طابع جبائي بقيمة 20 دج.

» الحالة الثانية: الولد المولود بعد اكتساب أمه الجنسية الجزائرية:

› شهادة ميلاد المعني أصلية صادرة عن بلدية مكان ميلاده.
› نسخة من مرسوم اكتساب الأم الجنسية الجزائرية.
› طابع جبائي بقيمة 20 دج.

» الحالة الثالثة: من تحصلت والدته على الجنسية الجزائرية بموجب حكم قضائي:

› شهادة ميلاد المعني أصلية صادرة عن بلدية مكان ميلاده.
› شهادة ميلاد الأم أصلية صادرة عن بلدية مكان ميلادها.
› نسخة تنفيذية للحكم القضائي المثبت للأم جنسيتها الجزائرية.
› طابع جبائي بقيمة 20 دج.

ب- الجنسية الأصلية بالولادة في الجزائر: المادة 7 من قانون الجنسية الجزائرية، و لها حالتان:

» الحالة الأولى: المولودين بالجزائر من أبوين مجهولين:

› شهادة ميلاد المعني أصلية صادرة عن بلدية مكان ميلاده.
› طابع جبائي بقيمة 20 دج.

» الحالة الثانية: المولودين في الجزائر من أم مسماة فقط:

› شهادة ميلاد المعني أصلية صادرة عن بلدية مكان ميلاده.
› شهادة مسلمة من طرف الهيئات المختصة بالطفولة المسعفة.
› طابع جبائي بقيمة 20 دج.

ج- الجنسية الأصلية بالإثبات بحكم قضائي:

الوثائق المطلوبة لاستخراج شهادة الجنسية الجزائرية لمن تحصلوا على الجنسية الجزائرية الأصلية بموجب حكم قضائي:

› شهادة ميلاد المعني أصلية صادرة عن بلدية مكان ميلاده.
› نسخة تنفيذية للحكم القضائي المثبت له جنسيته الجزائرية.
› طابع جبائي بقيمة 20 دج.

• في حالة عدم توفر شهادة ميلاد الأب أو شهادة ميلاد الجد لعدم تسجيلهما في سجلات الحالة المدنية، يجوز تقديم شهادة الوفاة شريطة أن تتضمن هذه الأخيرة تاريخ و مكان الميلاد.

• أما في حالة عدم وجود شهادة ميلاد أو وفاة الجد، لانعدام التسجيل في سجلات الحالة المدنية، يمكن تقديم عقد لفيف الجد بشرط أن يكون الشاهدان ممن يصدق شهادتهما الحدس العام.

• أما في حالة عدم توفر جميع هذه الوثائق، و ادعى الشخص أنه من جنسية جزائرية أصلية، فعليه رفع دعوى قضائية لإثبات الجنسية الجزائرية بحكم قضائي عن طريق الحالة الظاهرة.

ثانيا: الجنسية الجزائرية المكتسبة:
الوثائق المطلوبة لاستخراج شهادة الجنسية الجزائرية المكتسبة:

› شهادة ميلاد المعني أصلية صادرة عن بلدية مكان ميلاده.
› نسخة من مرسوم اكتساب المعني الجنسية الجزائرية.
› طابع جبائي بقيمة 20 دج.

• اكتساب الجنسية الجزائرية:

يمكن لكل أجنبي بلغ سن الرشد القانونية (19) سنة و أثبت إقامته
و اندماجه في المجتمع الجزائري، أن يقدم طلب إلى السيد وزير العدل، حافظ الأختام، لاكتساب الجنسية الجزائرية، سواء عن طريق الزواج (المادة 9 مكرر) أو بالتجنس (المادة 10) من قانون الجنسية الجزائرية المعدل
و المتمم.


» ملف اكتساب الجنسية الجزائرية عن طريق الزواج (المادة
التاسعة 9 مكرر):

› نسخة من عقد ميلاد المعني أصلية صادرة عن بلدية مكان ميلاده، بالنسبة للمولودين بالتراب الوطني، أما الأشخاص المولودين بالخارج فيشترط تقديم نسخة أصلية من رسم ميلادهم مترجم للغة العربية بالنسبة لغير العرب.
› نسخة من عقد الزواج شرط أن يكون الزواج قائم لمدة لا تقل عن ثلاثة سنوات.
› نسخة من صحيفة السوابق القضائية رقم 03.
› شهادة الإقامة رقم 04 تحدد الإقامة بالقطر الجزائري لمدة لا تقل عن سنتين (2) يوم تقديم الطلب، تستخرج من مصالح الأمن.
› ثلاث (03) صور شمسية.
› شهادة عمل أو نسخة من السجل التجاري أو أي شهادة أخرى تثبت مصدر المعيشة.
› مستخرج من مصلحة الضرائب (شهادة عدم الخضوع للضرائب).


» ملف اكتساب الجنسية الجزائرية بالتجنس (المادة العاشرة
10):

› نسخة من عقد ميلاد المعني أصلية صادرة عن بلدية مكان ميلاده بالنسبة للمولودين بالتراب الوطني، أما الأشخاص المولودين بالخارج فيشترط تقديم نسخة أصلية من رسم ميلادهم مترجم للغة العربية بالنسبة لغير العرب.
› نسخة من صحيفة السوابق القضائية رقم 03.
› شهادة الإقامة رقم 04 تحدد الإقامة بالقطر الجزائري لمدة لا تقل عن
7 سنوات، يوم تقديم الطلب تستخرج من مصالح الأمن.
› شهادة عدم الفقر.
› شهادتين طبيتين تثبت سلامة الجسد و العقل.
› شهادة عمل أو نسخة من السجل التجاري أو أي شهادة أخرى تثبت مصدر المعيشة.
› نسخة من عقد الزواج.
› ثلاث (03) صور شمسية.
› مستخرج من مصلحة الضرائب (شهادة عدم الخضوع للضرائب).
