الحصانة القانونية نعرفها للسادة أعضاء البرلمان ومجلس الأمة بالنسبة للوزراء ليس لديهم حصانة أما القصاة يوجد هناك ما يسمى بواجب التحفظ المهني للمنصب... والله اعلم

الحصانة الدبلوماسية هي نوع من الحصانة القانونية وسياسة متبعة بين الحكومات تضمن عدم ملاحقة ومحاكمة الدبلوماسيين تحت طائلة قوانين الدولة المضيفة. تم الاتفاق على الحصانة الدبلوماسية كقانون دولي في مؤتمر فيينا للعلاقات الدبلوماسية الذي عقد في 1961.
هناك مايسمى
الحَصانة الدبلوماسية مصطلح قانوني للامتياز الذي يمُنح إلى بعض الناس الذين يعيشون في البلاد الأجنبية. وهو يسمح لهم أن يظلوا خاضعين لسلطة القوانين في بلادهم. فالسفراء أو الوزراء والوكلاء الدبلوماسيون الآخرون يُمْنَحون هذا الامتياز. ومثل هؤلاء الوكلاء لا يمكن القبض عليهم لمخالفة قوانين البلاد التي يُرسلون إليها. ولكن إذا خالفوا القوانين المحلية فإن حكوماتهم قد تطالب باستدعائهم، وهناك اتفاقات دولية تنظم معاملة الوكلاء الدبلوماسيين والمكان الطبيعي الذي تشغله السفارات وأماكن المندوبين الرسميين، والقنصليات في البلاد الأجنبية.

الحصانة الدبلوماسية واحدة من الاوراق السياسية والقانونية الرابحة للاشخاص البلوماسيين الذين يواجهون الضغوطات والتهديدات الممارسة من قبل الأنظمة التي تطالب بمحاكمتهم أو تصفيتهم في بعض الأحيان وتعتبر الوسيلة المثلى لكف هده الضغوطات

كلاهما لا يتمتع بالحصانة القانونية ،،،

الوزراء : الوزراء و الوزراء المنتدبون كلهم معينون من قبل رئيس الجمهورية و يعتبرون ذوو المناصب التنفيذية .
يجوز مساءلة أعضاء الحكومة عن الجرائم أمام المحاكم العادية ، وفقاً الإجراءات المنصوص عليها في المادة 573 و ما يليها من قانون الإجراءات الجزائية في الباب الثامن المتعلق بالجرائم و الجنح المرتكبة من طرف أعضاء الحكومة و القضاة و بعض الموظفين .

القضاة : القضاة ينقسمون إلى فتتين :
- القضاة التابعون لنظام القضاء العادي ، و قضاة تابعون لنظام القضاء الإداري و تطبق على كلاهما لنفس أحكام المادة 573 من قانون الإجراءات أعلاه .
