السلام عليكم.انا أملك مقهى انترنت و لدي عقد كراء ينتهي إلى غاية 2014 ، فقد قام صاحب البيت بالدخول إلى محلي و الإستلاء على ممتلكاتي ووثائقي ، قمت بتقديم شكوى لدى المدعي العام و الشرطة لكن لم يتم الرد بعد بعد مرور أسبوعين ن مع العلم ان صاحب البيت محامي و يستخدم نفوذه و يقوم بإفساد محلي ، أردت الإستعانة من محامي خارج الولاية لكن نفس المشكل و حجتهم لا نستطيع أن نقف ضد محامي ماذا تنصحوني جزاكم الله خير

من التزامات المؤجر عدم التعرض للمستاجر في استغلال العين المؤجرة ، في حالتك مادام يوجد عندك عقد ايجار رسمي عليك القيام بما يلي :
01 ـــ التوجه الى رئيس المحكمة من اجل الحصول على امر بتعين محضر قضائي لاجراء معاينة على المحل و جرد املاكه الموجودة بها و هل تعرضت للاتلاف كما تصرح.
02 ـــ هنا امامك احد الخيارين اما الخيار الجزائي او المدني اذا اخترت الحيار الاول توجه الى وكيل الجمهورية و تقدم بشكوى ضد المؤجر فسلوك المؤجر يشكل خطا جزائي لكن لا انصحك باتباع هذا الخيار فهو طويل و فائدته قليلة انصحك بالخيار الثاني هو الخيار المدني اي تسجيل دعوى امام امام المحكمة بطلب عدم التعرض لك في استغلال المحل المؤجر لك لغاية نهاية مدة عقد الايجار و طلب التعوبض عن كل الخسائر التي تعرضت لها بسبب اتلاف عتادك و املاكك
اما فيما يخص توجهك للمحامين و رفضهم التكفل بقضيتك و لو انني انا ارفض هذا النوع من التبرير لان من حق كل واحد في الدفاع مهما كان نوع و طبيعة الخصم لكن دفع للاحراج تجد بعض المحامين يتجنبون التكفل بقضايا فيها نوعية معينة من الاشخاص مثلا محامي في قضيتك لكن هذا لا يمنعك من الحصول على الدفاع و هنا لك طريقيتن :
اما النوجه الى مقر منظمة المحامين فيتم تعين لك محامي للتكفل بقضيتك و هذا عمليا جائز و موجود و اما التوجه الى وكيل الجمهورية بطلب تعين محامي لك في اطار المساعدة القضائية

وخاصة انك مستاجر ولم ينتهي عقد الايجار واي محامي من ولاية اخرى يتكفل بقضيتك
