بيان وتوضيح من الشيخ عبد الغني عويسات حول ما نشر عنه في جريدة النهار

نشرت جريدة النهار الجزائرية فتوى للشيخ الفاضل عبد الغني عوسات حفظه الله ومفادها أنه يبارك القروض غير الربوية، ويخيل للقارئ أن الشيخ يقصد الخطوة الأخيرة التي قامت بها الحكومة الجزائرية حيال التكفّل بفوائد قروض (لونساج) عن المستفيدين هي بمثابة "إلغاء للفوائد الربوية"، والمقصود من كلام الشيخ كما وضح في الفتوى المنشورة، وأيضا كما قال لي عندما اتصلت به صباح هذا اليوم، أنه يشترط في القروض الممنوحة للشباب أن تكون خالية من الفوائد الربوية، وذلك بإلغاء الحكومة لجميع الفوائد المترتبة عن هذه القروض، وهذا الأمر لم تقم به الحكومة، بل هي فقط قامت بالتكفل بهذه بتسديد الفوائد الربوية على القرض الممنوح، فعندها قال الشيخ أن هذا التعامل لا يجوز مطلقا، وأكد هو وغيره من أهل العلم كالشيخ فركوس، بأنّ "الإعانة المالية متمثلة في قرض من البنك يمنح للمستفيد، تتكفل الدولة بتسديد الفوائد الربوية المترتبة عن القرض الممنوح، ففي هذه الحالة يحرم هذا التعامل، لاشتماله على الربا المحرّم بالنصوص الشرعية، إذ لا يخرج القرض عن كونه ربويا في الأصل، بغض النظر عن مسدده سواء المستفيد أو غيره، للنصوص الوعيدية الواردة في هذا التعامل". كما جاء هذا في موقعه الشيخ فركوس.
وهنا ليعلم الجميع أنّ الخطوة الأخيرة من الدولة هي بمثابة "إسقاط شبهة الربا عن المستفيدين"، إلا أنّ "صفة الربا" لا تسقط عن العقد، ليبقى إثمه ووزره على كل الأطراف
